That’s the debate in a state where last month a judge tossed out Pennsylvania’s presidential primary and ordered the Republican winner to concede. As a result, Democrat Katie McGinty will face off against the Republican incumbent, US Sen. Pat Toomey, who was elected in 2010 on a wave of white backlash to the previous state’s Democratic presidential nominee, Barack Obama.

As he did on Tuesday, Toomey accused McGinty of “cheating” the state out of its vote by running her campaign in part on fears that Pennsylvania Republicans might attempt to block her confirmation.

“I don’t know if it’s going to get past that point on (Tuesday),” Toomey told reporters. “I think we should have the votes for Supreme Court justices and I don’t know that Republicans will stop the process.”

“I think it’s more difficult to prove that we cheated than a campaign ad,” he said.

“I was arrested for a fake crime. I was not arrested for anything that wasn’t real,” McGinty said.

If you look at the criminal complaint made on Monday, it does not mention Obama, the Democratic presidential nominee, while the complaint made against McGinty does. But if what Toomey was referring to is the first charge listed, “Misconduct by a Member of the Administrative Board of Elections, in relation to the filing of a nominating petition” in Pennsylvania’s special presidential primary election — that was filed against McGinty — it’s not clear McGinty was being charged for running a campaign based on fear
